Eleven ‘illegal’ cabbies banned from streets in police crackdown

Eleven cab drivers who were deemed to be putting the public in danger by operating illegally had their licences suspended immediately during a crackdown in Bradford city centre.

Police special constables joined forces with officers from Bradford Council’s hackney carriage and private hire licensing team to carry out random spot checks on vehicles in Vicar Lane and Westgate.

Of 53 drivers stopped and checked throughout the day, 11 were immediately suspended by enforcement officers for problems such as document offences and vehicle defects. Six drivers were also given advice by officers. Despite inquiries from the Telegraph & Argus to both West Yorkshire Police and Bradford Council, neither was able to say how many of the vehicles were hackney carriages and how many were private hire vehicles.

Bradford South special constabulary senior section officer Gerry Slade said those caught with faulty vehicles during Saturday’s operation were “putting passengers’ lives at risk.”

He said: “On top of those suspended, a number of fixed penalty tickets were also issued as part of this operation.

“One driver received a £60 fine and three penalty points on their licence for having defective tyres. Another was handed a defect rectification notice for having insufficient tread allowing a period of time to have it fixed or face prosecution.

“Of the drivers we stopped and spoke to, a majority of their vehicles were of good standard and happy to co-operate in the operation.

“It is imperative, however that those who are not operating within the law are identified as they are potentially putting their passengers’ safety in jeopardy. These checks mean we can catch any defects on cars used for public transport early while ensuring that drivers are keeping to the terms of their licence.”

Bradford Special Constabulary acting section officer Sarah Acton said they also made 32 stop checks on general motorists in the city.

“One vehicle was seized for the driver not having a licence and he was summonsed to court. Another was summonsed for failing to wear a seatbelt.

“Various fixed penalty tickets were issued for those driving with faulty tyres and lights. Others were handed tickets for driving whilst being on a mobile phone and for not wearing seat belts. Each of these carries a fine of £60 and a three points.

“This is an example of the good partnership work between the Council and the police and underlines our efforts to ensure taxis and private hire vehicles are safe”

Police Response to Sikh Protest

Bedfordshire Police are in consultation and negotiation with members of the Sikh community following a protest by around 250 people outside Luton Police Station last night (Tuesday May 29).

The Sikh community attended the police station at around 9pm to air their concerns about an assault on a young woman from their community that had been reported the day before.

Senior officers had earlier attended the Gurdwara in Dallow Road to meet with Luton Sikh community leaders and other interested parties to explain and share information regarding the criminal investigation so far. This concluded satisfactorily and the officers left. An hour later a wider group, including Sikhs from outside of the town arrived at the Buxton Road police station to discuss the issues further.

After considerable negotiation with representatives from the group, who were invited into the police station to talk, the protestors left at 11pm.

Bedfordshire Police continues to work with the Sikh community and other key stakeholders to ensure that they are kept informed.

Chief Superintendent Mike Colbourne said: “Obviously we have a duty to facilitate lawful, peaceful protest and if people have concerns it is right they are aired responsibly. Our priority first and foremost, however, is with the victim in this matter and her family.”

Which is the more serious offence do you think? Being drunk on a train and shouting some mild racial abuse or trying to kick someone to death while calling them a “white slag”? Well in today’s Britain, the shouting abuse offence is the one that gets treated most harshly. Our legal system is geared towards throwing the book at white people who dare question the mass invasion of our country by immigrants, many of whom are here only to abuse our benefits system, and many who have out and out hatred for us and cant even be bothered to try and disguise it.

She had done the same thing once before but the reality of the matter is, what she is guilty of here is a Section 5 public order offence, which should get her an £80 spot fine. Instead because it is “racially aggravated” she is jailed. 11 people were jailed recently in Carlisle for the same sort of thing, where no violence was used, just insulting/racist words. The police, CPS and Judges are DESPERATE to show their “anti racist” credentials, and will lock up any racist person that finds themselves at their mercy.

At the same time, the police, CPS and Judges also want to show how “not racist” they are by being leniant on any immigrants that appear before them. “I KILLED her. . . I was just angry.”

This is the chilling moment police claim a takeaway boss admitted to the murder of Blackpool schoolgirl Charlene Downes.

 

Iyad Bassar Albattikhi was heard making the admission after police bugged a work colleague’s home, a murder trial was told.

 

Officers set up the covert listening device after they became suspicious of the co-owners of Funny Boyz takeaway in Blackpool.

 

Witnesses say Albattikhi had earlier joked with fellow takeaway employees how 14-year-old Charlene had been “chopped up” and her body had “gone into the kebabs”.

 

Albattikhi, 29, had been having sex with Charlene before she died, the jury was

 

told.

 

She was one of a number of young white girls who went into alleyways behind restaurants in Blackpool to have sex with the men who worked in the takeaways.

 

Charlene went missing in November 2003. Her body has never been found.

 

Prosecutor Tim Holroyde, QC, told Preston Crown Court Albattikhi and others

 

had openly talked about Charlene.

 

He said: “These people were talking about sex with white girls and there was mention of having sex with Charlene.

 

“Albattikhi laughed and said she was kinky and she was very small – the plainest possible indication that he was lying to the police when he said he did not know her.

 

“He and others present were then laughingly saying that Charlene had gone into the kebabs.”

 

Police targeted Albattikhi, a Jordanian immigrant, and his colleague Mohammed Reveshi, who is originally from Iran, after information from witnesses.

 

Both had a financial stake in Funny Boyz on Dickson Road.

 

Albattikhi is charged with murder while Reveshi, 50, is charged with helping Albattikhi dispose of Charlene’s body.

 

Both men deny the charges and have told police they never knew the girl.

 

Officers bugged Reveshi’s home in Hornby Road and his car and taped several conversations between Albattikhi, of Dickson Road, and Reveshi.

 

The prosecution claims Charlene, of Buchanan Street, was killed by Albattikhi on the day, or days after, she waved goodbye to her mother, Karen, on November 1, 2003.

 

On one of the tapes police say Albattikhi, also known to witnesses as Eddie, can be heard saying, “I killed her, I killed a girl”, explaining “I was just angry” to Reveshi who reassures his co-accused by telling him: “There is nothing left of her. She was here, she died, there really is nothing.”

 

Mr Holroyde added: “Shortly after Albattikhi had admitted the killing, there is Reveshi admitting that Charlene Downes had been in the flat and that she had died, but saying there was nothing left of her for the police to find.”

 

The jury listened to another tape in which Reveshi told his co-defendant they had nothing to worry about after police carried out a thorough search of his flat on Hornby Road.

 

In reply to a question from Albattikhi about how long fingerprints lasted, he was heard to have said: “Believe you me, don’t worry, there is nothing they can find.”

 

Despite Reveshi’s reassurance to his co-defendant that the police would not find any evidence of a crime in his flat, the court was told that Reveshi had begun to crack under the strain of the police investigation.

 

In a tape recording, Reveshi was heard saying: “I cannot cope to be honest, I cannot cope anymore.

 

“I don’t know how to sleep – I just cannot forgive myself. I cannot talk to be honest about that girl.”

 

Mr Holroyde claimed that Reveshi was showing signs that he could not cope with being a suspect.

 

He added: “Of course, anyone who was wrongly arrested – as Reveshi claims he was – would be upset; but we suggest the stress Reveshi is displaying there goes way beyond that, and is the stress felt by a man who thought he had got away with his crime but was now dreading the police finding the evidence to prove what he had done.”

 

Police spoke to Albattikhi and Reveshi after Charlene disappeared but they insisted they did not know her, the jury was told.

 

Mr Holroyde claimed they lied about knowing Charlene because “one of them murdered her and the other has disposed of the body”.

POLICE have handed an harassment warning notice to the mother of missing schoolgirl Charlene Downes after she distributed leaflets about the two men acquitted of killing her daughter and disposing of her body.

 

But Karen Downes has refused to sign the order and says she would rather “put herself in prison” than agree to the notice.

The 46-year-old said: “I’m very upset. I’m Charlene’s mother and I should be allowed to peacefully protest.

“I’m entitled to make my point of view.

“I won’t sign it. I will put myself in prison for this.

“There is no way I will sign this, they can arrest me.”

Leaflets

Mrs Downes was with a group of friends when she handed out leaflets implicating Iyad Albattikhi and Mohammed Reveshi in her daughter’s disappearance.

The St George’s High School pupil has not been seen since November 2003 when she disappeared, aged 13.

Iyad Albattikhi and Mohammed Reveshi, owners of the former Funny Boyz takeaway on Dickson Road, were arrested as part of the murder investigation.

Mr Albattikhi was accused of murder and Mr Reveshi was charged with helping dispose of a body but both denied ever meeting Charlene. They were later acquitted of all charges.

Mrs Downes admitted posting leaflets through letterboxes on St Chad’s Road and handed others out on the Promenade.

The harassment notice was posted through Mrs Downes’ home on George Street, Blackpool, when she refused to speak to the police.

She added: “I wouldn’t speak to them, I was so angry.

“I think it is a disgrace.”

The harassment notice requests Mrs Downes does not communicate with Mr Albattikhi or Mr Reveshi by letter, telephone or computer.

She has been asked not to enter Mad About Chicken on Talbot Road, Cafe Express Shop, on St Chad’s Road, and Yum Yum Fish and Chips Shop, on the Promenade.

Mrs Downes has also been told she should not distribute or send leaflets which contain references to Mr Albattikhi or Mr Reveshi.

A spokesman for Lancashire Police confirmed: “A 46-year-old woman from Blackpool has been issued with an harassment order following the distribution of a number of leaflets in the Blackpool area relating to the on-going Charlene Downes murder investigation.”

Mrs Downes will now take part in a ‘Justice for Charlene’ event in Blackpool.

She added: “There will be a demo at 12pm on Saturday, June 9.

“We’ll be starting from Yates’s pub in South Shore.

“All we want is justice for Charlene.”

If this is true then those people should be ashamed of themselves. Senior Brighton and Hove Green backs EDO march

A councillor is urging people to join anti-arms demonstrators on the streets during the Queen’s jubilee celebrations.

Senior Green Ben Duncan says he is planning to take part in aSmash EDO protest in central Brighton on June 4.

The demonstration has caused controversy, with city centre business leaders saying it will damage tourism on the third day of the public holiday.

Coun Duncan is Brighton and Hove City Council’s cabinet member for communities, equalities and public protection, and represents the city on Sussex Police Authority.

He has faced criticism in the past for his support for Smash EDO, which campaigns to close the EDO factory in Home Farm Road, Brighton. The group’s protests have frequently ended in clashes with police.

Coun Duncan said he wants to encourage people to make the June 4 demo – which is being billed as a protest against a war with Iran – a mainstream event.

He told The Argus: “I very much hope that others in the city take the same view and anyone who believes that we should not be an arms trading nation and should not have a weapons factory in Brighton is inspired to get along and take part and make their views be counted.”

The event is expected to involve a march from North Street to Hove Town Hall.

It is part of a ‘summer of resist- ance’, which starts on Tuesday.

Demonstrations are planned at the factory and at Barclays in North Street.

The bank is being targeted because the group says it deals with EDO’s parent company, ITT, in America. City centre traders have spoken out against plans for the June 4 demonstration, saying it will affect small busi- nesses, which rely on visitors using the city centre.

David Sewell, chairman of the North Laine Traders Asso- ciation, said Coun Duncan should pay attention to the needs of businesses.

He said: “You can’t have your elected people not helping the city as a whole. They might support a principle but, for the wider good of Brighton, that might not be a good thing.

“All businesses would say they hope the party in power isn’t giving the impression this is good for Brighton.”

Another demonstration has been planned for the city centre in May. Brighton Uncut has announced a “Free Brighton Street Party” to take place from noon on May 26 at the Clock Tower in Queen’s Road.

The group’s previous events, which have aimed to embarrass companies it says do not pay their fair share of tax, have led to large-scale police operations.

Greens Fail to Condemn Jubilee Disruption Plans

Conservative councillors have criticised the Green Administration for refusing to condemn the disruption to the Queen’s Diamond Jubilee celebrations in Brighton & Hove being proposed by anarchist group Smash EDO.

At a meeting of the Full Council last week, a motion put forward by the Conservatives, calling on Smash EDO to abandon their plans, was opposed by Green members including Cllr. Ben Duncan – their Community Safety Cabinet Member and the Council’s sole member of the Sussex Police Authority.

Cllr. Duncan had already been criticised for controversial comments following the arrest of over 50 Smash EDO protestors at a previous demonstration, which cost taxpayers over £300,000 to police.

It is Green Party policy to abolish the monarchy, something they describe as an archaic institution. Cllr. Duncan has already written on his blog that he is getting “sick and tired of hearing about the Jubilee” and expressed his hope that members of the Royal Family are “significantly inconvenienced” by demonstrations over the Diamond Jubilee weekend. He added that his favourite badge design from the campaign group Coalition of Resistance, is “Stuff the Jubilee”.

Cllr. Graham Cox who sponsored the Council motion said: “At election time, the Green Party tend to keep quiet about their policy to abolish the Monarchy because they know that the vast majority of residents in Brighton & Hove are huge admirers of the Queen. We are extremely disappointed, although not altogether surprised, at Cllr. Duncan’s refusal to call on Smash EDO to abandon their plans to disrupt the Diamond Jubilee celebrations in Brighton & Hove.”

Cllr. Tony Janio, co-sponsor of the motion added: “EDO is a perfectly legal manufacturer of defence parts and equipment, some of which are used by our own RAF. In addition, they are a significant employer of local people. Frankly, Smash EDO and their supporters should be ashamed of themselves. We note that the Leader of the Council, Bill Randall, made a point of refusing to join in the debate – perhaps he was ashamed by the stance taken by some of his Green Party colleagues.”

West Mercia Police has sent a public thank you to the people of Redditch for their support in ensuring this afternoon’s (Saturday, May 26) assembly by the English Defence League (EDL) and a counter demonstration passed off largely peacefully.

Around 40 EDL supporters gathered for an assembly at the bandstand in Church Green West during the afternoon and about 200 counter demonstrators gathered in Easemore Road.

By the time the assemblies had dispersed at around 2pm there had been only three arrests – one for a breach of the peace and two on suspicion of assault. They were all men and believed to have been attached to the counter EDL demonstration.

All three were taken to a police station in Worcestershire.

After listening to speeches at the bandstand, EDL supporters were escorted by police back to the railway station where they had arrived earlier. Counter demonstrators then held a short gathering at the bandstand before dispersing.

Superintendent Adrian Pass of West Mercia Police said: “There were very few problems during the build-up to and during the assemblies and there have been no reports of damage to property.

“The success of the operation is due to a number of factors, not least the support from partner agencies who helped in preparing the town for today’s event and the fantastic co-operation we have had from the public.

“A significant number of officers and staff were involved in policing the protest and we would like to pay tribute to the professionalism of our colleagues from British Transport Police and neighbouring forces who were involved. We are grateful for their support.

Superintendent Pass said that in the main supporters of both rallies had been good natured and officers had encountered very few problems.

He said: “I realise that this has been a challenging time for everybody but the fact that the demonstrations have passed off largely without incident vindicates the decisions taken by us and our partners while planning our operation.

“What arrests there have been have followed isolated incidents and our officers on the ground responded to these and dealt with them quickly and robustly.

“This was a great effort by the whole community and it is a tribute to all those involved that the town is calm and everything is returning to normal so quickly.”

Police in Edinburgh said “public safety” was a priority as they prepared for a march by the far-right Scottish Defence League (SDL).

The SDL are to march along Regent Road to St Andrew’s House, the administrative home of the Scottish government, from 13:00.

A march and rally in opposition to the SDL will be held by a group called United Against Fascism.

They will gather at the Grassmarket and also march to St Andrew’s House.

‘Significant planning’United Against Fascism will pass through Victoria Street, George IV Bridge, High Street, North Bridge and into Waterloo Place before reaching St Andrew’s House in Regent Road, on the southern flank of Calton Hill.

In September a rally by the SDL in Edinburgh passed off without incident and without any arrests.

Lothian and Borders Police said it had undertaken “a significant amount of planning and a detailed policing plan” ahead of the marches.

A Lothian and Borders Police spokeswoman said: “The city is basking in glorious sunshine and Lothian and Borders Police aim to keep disruption to a minimum so that the general public can go about their daily business and enjoy the lovely weather.

“Our priorities will be to maintain public safety, minimise disruption to public order and facilitate the rights of freedom of assembly and speech.

“Lothian and Borders Police will also provide an appropriate and proportionate response to any anti-social behaviour and criminal activity, bringing those responsible to justice.”

Government inspectors from Ofsted have launched an investigation into one of the care homes at the heart of the Rochdale sexual abuse case.

Its management had been warned more than once in the last two years about its standards of care for vulnerable young people.

Accomodation is cheap in poverty stricken Rochdale. That’s one reason it has up to 47 private care homes that councils from across Britain use to house teenagers who have been referred to social services.

Up to 75 percent of children’s services in Britain are privatised. Green Corns was the company running the “solo care” home in Rochdale when its only resident was suffering sexual abuse.

Solo care means that a number of staff are dedicated to looking after one young person. This costs the council over £250,000 a year.

The work is a profitable business. Green Corns was bought up by private equity group 3i for £26 million in 2004 and became part of Continuum Care and Education Group. Annual operating profits reached £2.7 million.

In turn Continuum was bought up by Advanced Childcare Limited (ACL) which itself had been bought by another private equity company, GI partners, in April last year.

Then managing director, Alfred Foglio, boasted, “Advanced Childcare has pioneered the trend of managing children’s care services on behalf of budget constrained local authorities.”

ACL is now the largest provider of specialist children’s care and education services in Britain.

It reported an annual turnover of £15 million in 2010, up from £11 million a year earlier. Pre-tax profit increased to £2.6 million during that period, up from £700,000 in 2009.

Most of this income is from local authority contracts for residential care. The combined company now runs 143 children’s homes with 416 placements, 15 special schools and over 100 fostering placements.

The company’s founder Riz Khan has high hopes for future profits. He said, “We would be disappointed if we cannot at least double the size of the business in the next three to five years.”

A legal secretary savagely assaulted by a girl gang during the Royal Wedding celebrations today slammed a decision to let her attackers walk free from court.

Daniela Holischeck, 41, was left with a bloodied face after being battered by ‘raining fists’ following a street party to mark Prince William and Kate Middleton’s marriage in April last year.

Kalee Powell, 18, and Precious Gordon, 19, along with a 17-year-old who cannot be named, attacked her and fellow legal secretaryBirgit Habersetzer ’like a pack’ after spending the day boozing.

Gordon admitted affray and assaulting Ms Holischeck and Ms Harbersetzer, while Powell was convicted of affray for her part in the attack on Ms Holischeck after a trial at the Old Bailey.

Both were given community orders and told to pay a total of £300 compensation to their victims.

After the sentencing, Ms Holischeck, who worked for a City law firm, said she had been denied justice and was still haunted by the attack near her home in Kensal Rise.

Ms Holischeck said: ’It’ll probably be a bit of street cleaning for a year and won’t hurt them. But I will remember this for the rest of my life.

‘I’ve decided to move away from the area to the home counties. I’m trying to forget. I haven’t been allowed to do that until now.’

Ms Holischeck, who worked for City law firm Paul, Hastings, Janofsky & Walker, was left a bloodied mess and had pizza smeared in her hair during the beating.

She spent the night in A&E after the attack and had to take a fortnight off from work.

 

Judge Stephen Kramer QC said Ms Holischeck and her flatmate had been caught up in ‘an ugly incident in which mindless, drunken and unlawful violence was used’.

‘It must have been a shock and thoroughly frightening for the two women who were victims,’ he added.

‘I am satisfied what you both did you did that night because you were fuelled by alcohol, having gone to a street party and drunk alcohol celebrating the Royal Wedding.

‘You have each come within a whisker of a custodial sentence. I hope you both appreciate that and these courts will never see you in this sort of position again.’

Ms Holischeck told jurors she felt as if it was ‘raining fists’ during the 10-minute attack in Bathurst Gardens, Kensal Rise, northwest London, on April 30 last year.

She became so desperate she kicked out at a car in an attempt to start its alarm.

‘They managed to grab my hair and pull me to the ground, and started to kick me,’ she said.

‘I could feel pizza being rubbed in my hair – bits of cheese coming down on me. There was so much blood everywhere – my face was full of blood, my hair was full of blood.’

Ms Habersetzer, also a legal secretary, was also attacked while two boys from the group stood watching in Kensal Rise, London, just after midnight.

Miss Habersetzer had brought the pizza as a late night snack and was taking it home.

Prosecutor Helen Guest said: ‘As they passed on the pavement, one of the girls knocked the box out of the hands of Birgit Habersetzer, and then followed that up with a punch to her face.

‘She threatened to call the police, and then a girl came to Daniela Holischeck and started to attack her. She ended up on the floor, and they were kicking and punching her.’

The attack only came to an end when a passing police car pulled up. Powell told officers she was drunk but had been trying to stop the fight.

Ms Holischeck said she spent the night in A&E and had to take two weeks off sick.

‘I had some trapped nerves in my back, and was not able to get out of bed by myself for a week,’ she said.

‘I had friends come to help me get out of bed. I had a nose bleed from punches to the head.’

The two victims – both German – had been celebrating the wedding of Prince William to Kate Middleton in a local pub but had drunk only fruit juice because they were in training for a charity fun run.

Powell, of Northolt, northwest London, denied affray and common assault on Ms Holischeck and was convicted.

She was given a 12-month community order requiring her to spend a total of 24 hours at a senior attendance centre run by the Probation Service.

She will also be under a nightly 8pm to 8am curfew for three months and will have to pay £100 compensation to Ms Holischeck.

Gordon, of Kensal Rise, admitted affray and common assault on both victims.

It all sounds shocking doesnt it? A “mob” of racist extremists attacking a peaceful muslim mans house and terrifying his family, how terrible. He says “even now i cant answer my 9yr old daughter when she asks me why”? How awful it must have been.

The only problem with this massively “cool story” is that the facts of what actually happened are going to get in the way. You see, far from being a drunken mob, a large number of the people who protested at his house are clued up activists, and they had the foresight to get the whole event recorded on video.

That is what REALLY happened. Karim refused to face his constituents, ALL of whom were from the local area, and chose instead to phone the police. The police can be seen to arrive and had no problem with this legal protest.

At the end of the day, hes an MEP, who supports cruel halal slaughter, is only interested in helping his Muslim constituents and is paid £80,000 a year for nothing. These white, local people were of no interest to him.

After this protest they moved off to Brierfield, where suddenly, cars full of armed muslim youths arrived, no doubt summoned by a phone call from said MEP and our people were viciously attacked and had to defend themselves. Twelve of ours and a few muslims were arrested.

NONE of the charges relate to the visit to mr Karims house. But the North West CPS, the same CPS who have refused to prosecute the massive grooming/murder gang in Blackpool, called mr Karim as a witness, knowing that lies from such an “upstanding” citizen would go a long way.

Car minibus and motorbike parking is free please park at redditch train station car park on unicorn hill B97 4RB
please be there around 11.45am no later than 12.30pm

Train passengers should get off at redditch train station B97 4RB and book your train to arrive at 11.45am and no later than 12.15pm
where you will be met by edl stewards and gather in redditch train station car park till 1pm
Anyone traveling by train either get an all day return ticket or book return train between 3.00pm and 4.00pm

At 1.00pm everyone will march up unicorn hill then onto church green west into the bandstand area for the demo

At about 1.10pm the demo will start with the Legendary tony curtis on the stage and a few others
After demo all patriots will march back to redditch train station to make there way home by edl stewards

Due to west mercia polices hierarchy and redditch council all pubs in redditch will be closed from 10.00am till 4.00pm
you can bring your own drinks and have a drink on the carpark before and after demo
but there is a alcahol ban in redditch center itself so no alcahol at demo or on march so bring other beverages with you

This demo has been a nightmare to pull off we have been messed about from day one
this is not the bobby on the steets fault but the higheraki of the west mercia police force and redditch council

The pregnant daughter-in-law of hate cleric Abu Hamza tried to smuggle a mobile phone SIM card into his high security prison under her burka, the Appeal Court heard yesterday.

Security guards at Belmarsh Prison found the card in the coin pocket of her jeans beneath her flowing robes.

She had previously visited her hook-handed father-in-law behind bars, said Mr Justice Openshaw, and was ‘well aware’ that SIM cards were banned in prison.

Chaymae Smak, 28, of Wandsworth, south London, was jailed for 12 months at Blackfriars Crown Court on May 4 after she was convicted of conveying a prohibited article into prison.

She appealed her sentence in London’s Appeal Court yesterday – where the facts of her case emerged for the first time – claiming she should be released for the sake of her ten-month old son.

Mr Justice Openshaw said the SIM card was destined for Abu Hamza, who was held as a high risk inmate following his conviction for inciting murder and pending extradition on terror charges to the U.S..

 

 

Smak at first claimed she had put the SIM card in her pocket several days earlier and ‘forgotten about it’, said the judge, who added: ‘The jury clearly didn’t accept that claim.’

He said Smak, a single mother, had given birth to a baby boy in July last year, and that the boy’s grandmother was now struggling to raise him.

But, although the courts had to consider the ‘impact of custody on the child’, a deterrent sentence was justified, ruled the judge.

Smak’s lawyers claimed too much account was taken of the fact that the SIM card was destined for Abu Hamza.

But Mr Justice Openshaw, sitting with the Lord Chief  Justice, Lord Judge, and Mr Justice Irwin,  held: ‘It seems highly relevant to the seriousness of the offence that the prisoner she was visiting was Abu Hamza, who was detained as a Category A prisoner following his conviction for inciting murder.’

He added: ‘The particular danger of conveying a telephone SIM card to someone such as Abu Hamza is immediately obvious.

‘He could use it to convey messages of support to his followers outside, or use it to encourage or incite the commission of further offences.

‘The risk that this may come to pass is a seriously aggravating factor in the commission of this particular offence.’

The compassionate features of Smak’s case had to be considered, he said, but needed to be weighed against the risk to prison security and the public.

And he told the court: ‘It seems quite likely to us that she might have appreciated that, if convicted, she would be able to plead her personal circumstances as the carer of her child as part of her mitigation.’

It was clear that ‘alternative arrangements’ had now been made for her child’s care, the court heard, and Mr Justice Openshaw concluded: ‘We think 12 months fully reflected such mitigation as was offered.’

Smak stood in the dock of the court throughout the 30 minute hearing, clad in a robe and headscarf covering her face up to her eyes.
