As an anti-war activist I’ve seen my fair share of court rooms. While appearing in court is never routine, Monday’s pre-trial hearing at Westminster Magistrate’s Court should have been fairly straight forward; a chance to plead ‘not guilty’ and for the court to set a trial date for our action at Downing Street to mark ten years of war in Afghanistan. An exception to the usual process was that my co-defendant, Fr Martin Newell, was in prison having being sentenced to 24 days in Pentonville prison for non-payment of a fine in relation to a previous anti-war action at Northwood.

However the ‘routine’ nature of the appearance was interrupted by the sudden appearance of two plain clothes policemen in the waiting room who announced they needed to talk to me in private and then promptly served papers on me saying that they intended to apply to the court for an anti-social behaviour order (ASBO). The papers say that the terms of the order sought are as follows:

The defendant must not:

Enter or be in the City of Westminster except while passing through as a passenger on the London Underground.
Carry with you or be in possession of any can of spray paint, tin of paint, marker pen, chalk or charcoal in anyplace outside the city of Oxford.
Carry with you of be in possession of bolt croppers in any place outside the city of Oxford.

For a period of 10 years.

The policemen said they would be serving more papers on me after Christmas and then promptly left. I was a bit shocked to say the least and the court hearing was a bit of a blur. As Martin wasn’t produced from prison a further court hearing was set for 9th January.

A bogus car clamper who acted like a ‘modern day pirate’ by demanding cash for towed away cars has been jailed.

Mohammed Ashraf ran an unlicensed firm called ‘Clamp You!’ that brought misery to scores of drivers.

His staff would hide around street corners in a liveried van waiting for cars to clamp.

They would then tow them away before demanding up to £600 a time to release them.

Yesterday Ashraf, 31, was jailed for five and a half years for blackmail.

One doctor whose vehicle was unlawfully towed while he was at a New Year’s Eve party in Manchester agreed to sign his car over to Ashraf rather than pay to get it back because the car was worth less than the release fee.

Another man was clamped after he parked in a backstreet to pick up his wife – without even getting out of his car.

Police alerted by Ashraf’s  tactics discovered he duped his victims by using a fake ID badge created from photocopy paper stuck to a bank card.

It also emerged he had set up an illegal service, ‘RemoveAllPoints.Com’, which claimed it would help motorists avoid driving penalties – only for Ashraf to pass tickets on to an innocent driver who was then forced to travel to courts across Britain to prove his innocence.

At Manchester Crown Court, Ashraf, of Blackley, was found guilty of five charges of blackmail, two offences of possessing articles for use in fraud, three counts of perverting the course of justice and an offence under the Private Security Industry Act 2001.

 

Yesterday one of his victims, Mohammed Ali, 50, a taxi driver who was clamped and charged £150 despite legally parking outside a shop, said:

‘He’s harming people and he’s dangerous. The way he speaks and acts, he’s in his own little world. He doesn’t respect anyone apart from himself.’

The court heard Ashraf had enrolled on a course with the Security Industry Authority which regulates clampers but was not given a licence.

He set up Clamp You! in 2009 which went on to become Unauthorised Parking Solutions Ltd. Anyone who was clamped was given a telephone number to call.

Ashraf would answer and demand that the victim hand over a fee before the clamp was released.

Drivers were told that unless they paid £150 their car would be towed and they would face further costs of up to £400, not including storage fees.

One victim, Dr Stephen Cain, had parked his car on New Year’s Eve 2009, and returned the following day to find it had been towed away.

He contacted a number on a nearby sign but was told it would cost £600 to recover the car.

Dr Cain agreed to sign over the car to Ashraf rather than pay  and the clamper reportedly sold it for £450.

Another driver, Oksana Sabadisa, told the court she  was clamped in the car park  of the finance company where she worked. She took a picture  of Ashraf’s badge and number-plate so she could check it  was legitimate.

Ashraf also duped drivers into believing his service RemoveAll Points.Com was a legitimate way for them to remove penalties from their licences.

But instead Ashraf falsely nominated an innocent man to take all  the points and he was inundated with notices for offences from all over the country.

Amar Majeed – a former customer of a car hire firm Ashraf ran – was wrongly named as the man at the wheel of vehicles which jumped red lights and veered into bus lanes.

Mr Majeed was forced to go to courts across the country, at one point travelling from his home in Glasgow to Kent, to prove his innocence.

Passing sentence, Judge Michael Henshell said: ‘The facts of this case have demonstrated there is an urgent need for police to scrutinise the activities of car clamping operations.

‘In this case the defendant wasn’t properly authorised and the ID badge shown was utterly bogus.

‘The operation of his businesses was a form of piracy committed on the streets of this city in which cars were held hostage and backed up

A senior detective – who played a key role in the Charlene Downes murder probe – has been told she must resign.

 

Police chiefs have not revealed details of what led to the disciplinary hearing, but confirmed the officer’s behaviour and conduct “lets everybody down”.

Det Sgt Janet Beasant was tasked with transcribing secretly recorded conversations between two suspects.

They had been charged with murdering the Blackpool teenager and disposing of her body.

Part of the evidence used in the trial of the men said they could be heard boasting Charlene (pictured) had been chopped up and put into a mincing machine.

Following a disciplinary hearing by Lancashire Police, Det Sgt Beasant has been found guilty of misconduct and told she must leave the force.

Although not naming Det Sgt Beasant by name, a Lancashire Police statement confirmed: “Following a two-week internal hearing an independent panel has ruled a Lancashire Police officer must resign after finding them guilty of misconduct.”

The statement added: “The officer was found guilty of two counts of misconduct, for one of which they were required to resign, and one for which they were reprimanded. A third count was found not proven.”

Despite one of Lancashire Police’s biggest ever missing person’s inquiries Charlene, who was 14 when she disappeared in 2003, has never been found.

Following her disappearance allegations surfaced the St George’s High school pupil had been murdered at the former Funny Boyz takeaway on Dickson Road.

Owners of the takeaway Iyad Albattikhi, who was accused of murder, and Mohammed Reveshi, who was charged with helping dispose of a body, denied ever meeting Charlene.

The jury was told Det Sgt Beasant spent 2,500 hours over two years listening to 52 audio tapes of covert recordings gathered during the month-long surveillance of Reveshi’s car and Hornby Road flat prior to the trial.

During the 11-week trial in 2007, Preston Crown Court heard detectives believed they could hear reference to Charlene’s body being put into a mincing machine.

But Mr Reveshi and Mr Albattikhi walked free from court when a jury failed to reach a verdict.

A re-trial was ordered, but the case collapsed on the eve of the hearing after prosecutors withdrew the charges and the judge ordered not guilty verdicts be returned on both defendants.

The Independent Police Complaints Commission criticised the police investigation into Charlene’s disappearance in a report published in October 2009, which uncovered “a catalogue of errors”.

Following the decision of yesterday’s disciplinary panel, which was made up of senior officers from outside the Lancashire force, Supt Simon Giles, Lancashire Police’s head of professional standards, said: “Lancashire Police expects the highest professional standards from all our staff and the panel has found this individual’s conduct has fallen well short of these standards.

“This sort of behaviour and conduct lets everybody down – not just the police service but those the police serve. It is appropriate they have faced the consequences of their actions.

“The public of Lancashire can be reassured any conduct such as this will be robustly investigated, and it must be remembered the overwhelming majority of our staff take great pride in delivering a first class policing service.”

He added: “We have previously acknowledged that certain aspects of this case have not been well managed – specifically during the time prior to the trial – and for this we have apologised to the Downes family.

“Lancashire has a proud and successful tradition of investigating serious crime and many officers and police staff have spent a vast amount of time, effort and commitment on this case and their determination to solve it remains at the highest level.”

Det Sgt Beasant, who can appeal against the result of the disciplinary hearing, was unavailable for comment.

A Taliban veteran and a Muslim convert are facing jail after using a Manchester market stall to sign up volunteers to go to Afghanistan and kill British troops.

Munir Farooqi, 54, was said to be at the heart of a plot to encourage people to ‘fight, kill and die’ in a conflict with coalition troops.

Beside him in the dock at Manchester Crown Court was Muslim convert Matthew Newton, aged 29, who he was ‘mentoring’.

The pair were stopped when they unwittingly tried to recruit undercover police officers at markets in Manchester city centre and in Longsight. Munir Farooqi, of Victoria Terrace, Longsight, was convicted of preparing for acts of terrorism, three counts of soliciting to murder and one count of dissemination of terrorist publications.

Newton, of Stockport Road, Levenshulme, was convicted of preparing for acts of terrorism and two counts of dissemination of terrorist publications. The two men denied the charges during a four-month trial. But after four days of deliberation, the jury returned unanimous guilty
verdicts.

Munir Farooqi’s son, Harris Farooqi, 28, of Stockport Road, Levenshulme, Manchester, was cleared of engaging in conduct for the preparation of terrorism and walked free from court.

Wintworth and Lurline Deslandes are desperate to confirm suspicions that Saturday Hassan – who shot their public schoolboy son Darren in the head after being thrown out of the family’s pub is a foreign national so they can ensure he is deported if he is released from jail. But the Home Office refuses to give them the information – to protect the killer’s privacy.

Sitting in her small suburban house, Lurline Deslandes turns the pages of the family’s photo album and points to a picture of her son Darren.

It shows a sweet-looking boy dressed in his blue uniform at his new school, looking pleased.

‘We were so proud of Darren that day,’ says his mother.

‘He was a bright child so we scrimped and saved up to pay for him to go to public school at Dulwich College. He played rugby for their team. He loved it there and they have never forgotten him.’

Darren Deslandes had a glowing future ahead of him — a tribute to his parents, who had strived so hard to give their children the very best upbringing.

But today, he is no longer here; killed at the age of 34 in a mindless, brutal, slaughter by a gunman in the early hours of New Year’s Day nearly two years ago.

Mortally injured, he choked on his own blood, as the murderer turned his weapon on Darren’s younger brother, Junior, aged 25, shooting at him six times and maiming him for life.

Not content with that, the killer then attacked Darren and Junior’s 58-year-old father, Wintworth. He pushed the muzzle of the black gun in the pensioner’s mouth and fired.

In a terrifying episode of utter depravity, Wintworth heard three clicks but, thankfully, the chamber was, at last, empty of bullets.

 

 

Understandably, the Deslandes family, from Thornton Heath, South London, are still struggling to cope with what happened that night.

They watched the killer Saturday Hassan, an immigrant from South America’s Guyana, sentenced to life for a minimum of 37 years at the Old Bailey last year. But his murder conviction has brought them scant comfort.

Hassan’s gun has never been found and he has refused to tell police where it is.

Vile messages have been placed by friends of the killer on social networking sites saying they are pleased Darren is dead.

As a result, the family are scared stiff that Hassan may one day come back to take revenge on them, if he is ever set free in this country again.

They are desperate to confirm their suspicions that the 31-year-old was in Britain illegally, which would mean — as a foreign national — he must be deported back to his native South America on his release.

However, in a shocking decision revealed by the Mail this week, the family and their MP have been told by the UK Border Agency that all details of Hassan’s past are confidential under the 1998 Data Protection Act.

The authorities say the murderer must agree to any information on his immigration status being given to the family he destroyed, and to whom he has never apologised.

This has provoked a furious reaction in Parliament and from the local North Croydon MP Malcolm Wicks, who retorted: ‘The logic of that answer is that I should have written a nice letter saying: “Dear murderer, would you give your permission to find out if you are a foreign national so I can make sure in the future you are deported?” ’

In the House of Commons, during a debate on the deportation of foreign criminals, Mr Wicks said it was ‘total nonsense’.

The Immigration Minister Damian Green concurred that the situation was ‘absurd’ and Mr Wicks is now to call on Prime Minister David Cameron to change the Data Protection laws.

Mr Wicks said: ‘We hear all about the rights of the murderer, but nothing about the rights of his victims. It is the same story all the time.’

No wonder Mr and Mrs Deslandes, who were born in Jamaica, are angry. Angry, and in utter despair.

They cannot comprehend how the human rights of the man who destroyed their lives could come before their own. Not in Britain, the land whose values they so admired.

As Lurline Deslandes puts it: ‘This man forfeited his human rights when he pulled the trigger on Darren and killed him in cold blood. We are the victims and no one has protected us.

‘We are sick of people who walk into this country and do terrible things.

‘Many immigrants, like us, come here to make something of their lives, but others come to embark on a life of crime.

‘I would like the people in high places who make decisions about human rights to know what it feels like to have your child murdered. Then they might give more support to victims.

‘We have been crushed by him, emotionally, physically and financially. If Hassan had not been allowed into Britain, his attack on us would never have happened.

‘After the murder, he bought tickets for a flight back to Guyana. He was running away before the police found him. What we have been told now about his rights being protected is the final insult to our family.’

The Deslandes family are devout Roman Catholics and hardworking people. Lurline came to Britain from St Catherine’s, a parish of Jamaica, to join her parents, who were already settled here, in 1969.

Wintworth, her sweetheart, arrived only five years later after being turned down for entry by the UK immigration authorities three times.

Soon the couple had married and, a year later, Darren was born.

In 1984, they had a second son Junior, and then James, now aged 15. They took out a mortgage and bought their three-bedroom terrace home in Thornton Heath, where they brought up their children as decent, law-abiding citizens who ‘never had a shred of involvement with any violent or criminal behaviour’.

She worked as a clerical officer with British Gas and British Telecom before becoming a foster parent for children with special needs.

Meanwhile, Wintworth was employed in the City of London as an insurance underwriter for 25 years.

‘We used the money we earned to give our sons a good education and taught them to give something back to society,’ says Wintworth, as he sits at their home beside his wife.

He has just come out of hospital for lung cancer treatment; doctors fear his fight against the disease has been set back by the grief of losing Darren.

When Wintworth retired in 1999, the couple decided to open their own business and poured their life savings into it.

They bought the lease of a pub called the Newton Arms in Thornton Heath and turned it into a welcoming place for families.

‘We had barbecues and bouncy castles in the summer,’ explains Lurline. ‘It was so successful. People came from all backgrounds.

‘We worked long hours, but soon we had lots of regulars who brought their children because it was a safe and fun place to be.’

By now Darren’s career was blossoming on the back of his first-class education.

He had graduated from Brunel University and, for ten years, had been a manager at a South London housing association, helping his father at the pub on occasions.

Junior was training as an estate agent and also did stints at the Newton Arms.

James, still a schoolboy and brilliant footballer, had started at a local secondary school.

Yet the family’s happiness was not to last.

Every New Year’s Eve the Deslandes family threw a private party for their relatives, friends and the pub regulars.

And it was no different on December 31, 2009.

But this time one customer, a Guyanese man who often came in to play pool, brought a relative with him to the party whom they did not know.

It turned out to be Saturday Hassan, who lived locally on state benefits and was described by the judge at his Old Bailey trial as a ‘wannabe gangster’.

The party carried on happily until nearly 5am on New Year’s Day when some of the guests had left and others were getting ready to go. Then a row broke out.

According to evidence given in court, Hassan began quarrelling with another party-goer over a woman he had met.

He grabbed a bottle from the bar during the altercation and was thrown out of the pub by Darren and his younger brother Junior.

Hassan ran to his car and drove off, whereupon Wintworth closed the pub and told everyone to go home.

But, less than ten minutes later, before the Newton Arms was locked, Hassan returned in his car and marched in. He lifted up his t-shirt to show a gun tucked into his trousers.

As the remaining guests began to call 999, Hassan pulled out the gun and shot Darren in the head.

He then turned on Junior and said: ‘I’m going to kill you.’

As Darren fell to the ground, he fired shots at Junior who collapsed, too.

When Wintworth tried to stop the carnage, Hassan turned the weapon on him, before discovering it had run out of bullets then escaped out of the back door of the pub.

Darren was taken to hospital but never revived.

His brother Junior ended up in the critical care ward in a coma. His parents were told he could not survive his injuries.

Miraculously he has done so, although now, unable to work, he has trouble walking up or down stairs, has a pronounced limp, headaches, dizzy spells and damaged hearing.

Meanwhile, Lurline and Wintworth walked out of the Newton Arms that night for the last time.

They cannot face returning after the trauma.

They cradled Darren as he died in the doorway of the pub and saw him being carried away, dead, to an ambulance.

The couple’s lives are now in disarray. They have lost their life savings by closing down the pub.

They do not receive State benefits, as a small pension received by Wintworth from his City employers makes them ineligible. They still have a large mortgage on their house and neither parent can work because both are too traumatised by the killing.

Two witness statements written by Junior, to assist the judge in the sentencing of Hassan, reveal the tragedy that has befallen the Deslandes family.

The statements begged the judge to give Hassan (who pleaded not guilty) the longest ‘un-appeallable’ sentence possible to reflect his ‘wicked and deliberate’ act and to secure the family’s safety.

Junior’s statements goes on to explain: ‘My father will not return to the pub. He does not feel safe there and it only holds bad memories for him. I have heard him cry that he will never again hear Darren’s voice or touch him.

‘My father says his heart has been ripped out as he was not able to protect or save Darren when he most needed him.

‘His faith in mankind has been destroyed and he now trusts nobody.’

He adds: ‘My mother is just so sad. She suffers nightmares and flashbacks. She is heartbroken. I cannot imagine what my parents are going through.

‘Darren died in their arms. They were helpless to do anything about it. Now I watch their daily suffering and cannot take away their pain. No one can.

‘We have all lost an irreplaceable friend in Darren. Every morning we wake up, it dawns on us, and every night we go to sleep knowing we shall never see him again.

‘There is no escape from the nightmare and madness this man (Hassan) has inflicted upon us.’

So who, you might ask, are the victims here?

At the end of the three-week trial of Saturday Hassan, Judge David Paget told the unrepentant killer: ‘You have taken the life of a thoroughly good and worthy young man . . . devastating the lives of the whole Deslandes family.’ If anything, it was an understatement.

When I met the Deslandes family at their home this week, there was little talk of the festive season.

It is the time of year that reminds them most of what they have lost.

A MASKED gang who left a teenager brain damaged in a violent revenge attack for helping police have been jailed for a total of almost 20 years.

‘The Calder Street Boys’ Sohail Ilyas, 19, Amar Babar, 30, Qasim Niaz, 19, Ehsan Nazir, 19, and Hamayun Nawaz, 24, lured 19-year-old Mikhail Dinsi to a quiet Blackburn cul-de-sac in September 2010 and attacked him with sticks, bats, bricks, fists, feet and a knife.

Yesterday they were jailed for what police called ‘pure retribution’ after Mr Dinsi, now 20, supported an earlier investigation into a fight in Roosters takeaway, Johnston Street, in which his friend’s ear was bitten off.

The rival groups had a ‘simmering hatred’ between them when Mr Dinsi drove to Logwood Road. It was a trap and he was set on by 20 men. He was left fighting for his life and spent eight days in hospital with a hole in his skull and a jaw broken in three places. The prolonged and ‘brutal’ beating only stopped when a screaming woman intervened. Dinsi, now 20, was able to grab Babar’s balaclava, revealing his face, recognised Ilyas and spotted Nawaz because of his bright green eyes – Nawaz was known for wearing green contacts.

The investigation was originally treated as attempted murder and he still suffers long term post traumatic episodes. Police said he only survived because of the skill of medical staff.

Ilyas, of London Road, and Babar, of no fixed address were given five years five months and eight years respectively for conspiracy to inflict GBH and violent disorder. Babar was given an extra three months for his involvement in the July 2010 takeaway incident. Niaz, of Oak Street and Nazir, of Whalley Street, were jailed for nine months each for violent disorder. Nawaz, of Oozehead Lane, was jailed for three years for violent disorder and taking revenge.

All five men were given indefinite restraining orders to prevent any contact with or approach to Mr Dinsi.

Alongside Babar, three other men – Nasar Khan, Tariq Khan, and Latif Malik were jailed in October and given restraining orders for the original Roosters assault on Ali Shah.

Police have said they will closely monitor the tension between the groups. DCI Mark Gray said: “This was a brutal attack on a young man by a large number of people who were wielding weapons. The victim sustained extremely serious injuries that he has been extremely lucky to survive.

“I would like the sentences to serve as warning to anyone who thinks serious violent crime is acceptable.

“I would like to reassure the people of Blackburn that incidents of this nature are very rare and often stem from on going feuds between known groups and normal law-abiding citizens are not targets for this kind of criminality.”
